Terms and Conditions

These Terms and Conditions are made on behalf of Character Innovations Pty Ltd (ACN 131 525 150) trading as Just Smart Devices. All references to “Just Smart Devices”, “we”, “our” or “us” refer to Character Innovations Pty Ltd.

By purchasing or receiving goods or services from Just Smart Devices, you agree to the following terms and conditions.

Quotations

Any verbal or written quotation is based on limited information provided by you and is valid for 7 days from the date issued. Verbal quotes are indicative only and do not constitute a binding offer. Pricing is subject to confirmation upon inspection. Promotional pricing is valid only for the period stated or at our discretion. All pricing includes GST where applicable.

Warranty

Our warranty is provided in addition to your rights under the Australian Consumer Law. Goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for major failure and compensation for other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Just Smart Devices offers a 90-day warranty on all repair services. Faults caused by misuse, accidental damage, liquid ingress, or any issue unrelated to the original repair are excluded. We will determine whether a fault is due to a repair defect or customer misuse.

No warranty is provided for:

  • Devices sent without passcodes (as they cannot be tested),
  • Waterproofing after repair.

We make no warranty regarding data stored on the device and disclaim all liability for data loss. Remedies may include repair, replacement, or refund at our discretion.

Limited Liability

To the maximum extent permitted by law, Just Smart Devices is not liable for any direct, indirect, incidental, consequential, or special loss or damage arising from any product or service provided, including loss of data, income, or profits, even if advised of the possibility.

Our liability is limited to the lesser of the repair/replacement cost or purchase price paid. You acknowledge the inherent risks in electronics repair and assume those risks, including potential data loss or damage.

Confidentiality

We will not disclose any data stored on your device except to authorised personnel bound by confidentiality obligations or as required by law.

Privacy Policy

We comply with the Privacy Act 1988 (Cth). Personal information you provide is used to fulfil orders and communicate with you. We may share your data with third parties only where necessary (e.g. payment processors) and will not use your information for unrelated promotions.

Software Copyright

You warrant that any software provided for installation is properly licensed. You indemnify us against any claims arising from the installation of unlicensed software at your request.

Payment

Payment must be made in full via cash, credit card, bank transfer, or approved third-party provider (e.g. PayPal) upon completion of the service, unless otherwise agreed. Ownership of goods does not pass until full payment is received.

Unclaimed Repairs

In accordance with the South Australian Unclaimed Goods Act 1987, devices not collected within 3 months of repair completion may be considered abandoned and may be disposed of or sold to recover costs. No further notice will be provided.

Shipping

You are responsible for shipping costs, duties, and insurance to and from our premises. We do not accept responsibility for devices lost or damaged in transit. Devices shipped via third-party carriers are at your risk.

Dispute Resolution

Any disputes arising from these terms shall be resolved by arbitration under the rules of the Australian Institute of Arbitrators & Mediators. Either party may enforce the arbitrator’s decision in a court of competent jurisdiction. By agreeing to these terms, both parties waive their rights to trial by jury.
